By purchasing items, consigning works, or entering into layaway or payment agreements with Faust Gallery—whether in-gallery, online, or by phone—you agree to be bound by these Store Policies and Terms & Conditions. These policies govern all transactions unless otherwise agreed in a separate written and signed agreement.

Faust Gallery reserves the right to amend these policies at any time. Amendments take effect immediately upon being posted through official channels, including www.faustgallery.com. Any prior written agreement signed by both parties remains in effect and will not be superseded by amended policies unless a new written agreement is signed.

All items purchased through Faust Gallery (online or in-store) are sold on approval, contingent upon valid credit card authorization or confirmed payment at checkout. Accepted payment methods:

To pay by check, please contact Faust Gallery directly for the appropriate shipping address and payment instructions. Orders are processed only once payment is received and cleared.

Shipping Methods

All purchases are shipped via FedEx Insured, unless the item is oversized or requires special handling, in which case a qualified third-party shipping service will be used.

Shipping Costs

All shipping costs are the responsibility of the buyer, unless otherwise agreed in writing prior to shipment.

7-Day Approval Period

All items, online or in-gallery, are subject to a 7-day approval period, beginning on the date of delivery (online sales) or the date of purchase (in-gallery sales).

Return Process

To initiate a return within this period, notify Faust Gallery in writing (email or mail) or by phone. Upon approval, a return shipping label will be provided. All returned items must be in the same condition as originally sold, with no signs of damage or alteration.

Refunds & Restocking Fee

• Returns within the 7-day approval period are eligible for a full refund, unless otherwise specified in a separate agreement.
• Returns requested after the 7-day period may be subject to a 25% restocking fee, or may be eligible for store credit at Faust Gallery’s discretion.
• No returns will be accepted beyond 30 days from the original purchase date unless otherwise agreed in writing.

Refund Processing

Refunds are issued within 14 business days of receiving and approving the returned item.

Faust Gallery accepts consignments for sale at our Santa Fe, NM and Scottsdale, AZ locations, as well as online at www.faustgallery.com.

Written Agreement Required

All consignment arrangements—including terms of sale, duration, and commission rates—must be documented in a written consignment agreement signed by both Faust Gallery and the consignor prior to acceptance.

Out-of-State Consignors

If you are located outside Arizona or New Mexico, Faust Gallery may arrange to review your collection remotely, and shipping instructions will be provided. Consignors are responsible for shipping costs unless otherwise agreed in writing.

Faust Gallery offers a layaway payment plan for all items purchased in-gallery or online. Unless otherwise agreed in writing:

• A minimum down payment of 20% of the total purchase price is required to initiate the plan.
• The remaining balance is billed in equal installments over three (3) months from the date of the initial payment.
• No interest is charged on layaway payments.

Default & Cancellation

If the buyer fails to complete the plan within the agreed period, Faust Gallery reserves the right to cancel the agreement, retain the 20% deposit as a non-refundable fee, and return the item to inventory for sale.

To establish a layaway plan, please contact Faust Gallery directly to set up formal terms in writing.

Any prior written agreement signed by both Faust Gallery and the customer or consignor will take precedence over these Store Policies. Amendments to store policies will not affect existing signed agreements unless a new written agreement is mutually executed.

These Store Policies and Terms & Conditions, and any transaction, communication, consignment, or business relationship with Faust Gallery—whether in person, online, by phone, or by mail—are governed exclusively by the laws of the State of Arizona, without regard to conflict-of-laws principles.

Any dispute, claim, or cause of action arising out of or relating to these policies shall be brought solely and exclusively in the state or federal courts located in Maricopa County, Arizona. By engaging in business with Faust Gallery, you:

• Irrevocably submit to the exclusive jurisdiction and venue of the courts located in Maricopa County, Arizona;
• Waive any objection to venue or jurisdiction, including claims of forum non conveniens;
• Agree not to file suit, initiate mediation, or pursue arbitration in any jurisdiction other than the State of Arizona;
• Agree that Arizona law shall apply, even if you reside or transact outside Arizona.

International Buyers

Buyers located outside the United States are responsible for all customs duties, VAT, import taxes, brokerage fees, and international shipping regulations applicable in their jurisdiction. Faust Gallery does not assume liability for any international restrictions or customs delays.

Sales Tax Compliance

Faust Gallery collects and remits sales tax only as required under applicable laws of the State of Arizona. Buyers in other jurisdictions are solely responsible for reporting and paying any additional taxes due under their local regulations.

Any artwork, jewelry, or consigned item left with Faust Gallery for more than ninety (90) days without a signed consignment agreement, payment, or formal written communication may be deemed abandoned. Faust Gallery reserves the right to retain, dispose of, or resell such property at its sole discretion, without further notice or obligation to the original owner or potential buyer.

To the fullest extent permitted by law, Faust Gallery’s total liability to any customer, consignor, or third party for any claim—whether in contract, tort, or otherwise—shall not exceed the wholesale amount for the item or service in question. Under no circumstances shall Faust Gallery be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits or goodwill.
